In a statement made public on the 20th of March, 2017, the AYAH’s family rebuke newspaper reports the Supreme Court advocate General Justice Ayah Paul Abine has been formaly charged by the Biya’s regime.
The family further to challenge any one with proof of the charges to make it public, calling on those propagating the news as detractors. They insist that since his arrest close to two months ago Ayah has not been FORMALLY CHARGED and advice this dishonesty and misinformation should stop.
Below is what wrote,
“Permit us be very clear about this: AYAH PAUL ABINE IS YET TO BE FORMALLY CHARGED OF ANY CRIME FOR CLOSE TO TWO MONTHS UNDER FALSE DETENTION, PLEASE!!!! Let detractors please STOP the lie telling. What is a charge according to the law?
According to section 164, 167, 169 and 170 of the Criminal Procedure Code of the Republic of Cameroon, by a charge we refer to a formal notification of the wrongdoing/crime of a defendant on a precise date in a precise place which is in violation of precise legal dispositions and punishable by such, which is done by a competent examining magistrate before whom a victim is immediately brought to him upon his/her arrest. We invite all concerned Cameroonians to consult those sections of the said code for knowledge of the law.
A charge is different from journalism. Telling people you have been charged with terrorism, seccession, rebellion, etc does not amount to a charge; that is journalism and ignorance. A charge must state the crimes you have committed, the place of commission, the legal dispositions you violated, the punishmment metted to them, your full names and address, you place of abode if necessary, the examining magistrate charging you and his visa, etc….
On this count, we state again loud and clear that Ayah Paul Abine has not been charged for close to two months since his illegal arrest and we challenge anyone who says the contrary to humbly consult these legal provisions and present to us the contrary.”The family said.
Meanwhile, alafnet.com is aware that Justice Ayah Paul Abine is expected at 11: AM the Mfoundi High Court today Tuesday March 21, 2017 for the verdict by the President of the Yaounde based Court, regarding the petition by Ayah and co for his immediate and unconditional release.
Ayah is still been detained at the SED Yaoundé since his illegal arrest on January 21, 2017. And this publication will be bringing you details on decision of the Mfoundi High Court latter on today.
